General Terms and Conditions
The present conditions of sale are concluded on the one hand by www.lucbianco.fr, represented by Luc Bianco in his capacity as a micro-entrepreneur, SIRET number: 809 638 091 00011, hereinafter referred to as Virtual Landscapes, and on the other hand, by any individual or legal entity wishing to make a purchase via the Virtual Landscapes website, hereinafter referred to as “the Buyer”.
ARTICLE 1: Purpose
The present conditions of sale aim to define the contractual relations between Virtual Landscapes and the buyer and the conditions applicable to any purchase made through the website www.lucbianco.fr, whether the buyer is a professional or a consumer. The acquisition of a creation through the present site implies an acceptance without reserve by the buyer of the present conditions of sale. These conditions of sale shall prevail over any other general or particular conditions not expressly approved by Virtual Landscapes.
Virtual Landscapes reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in effect at the date of the order by the Buyer.
ARTICLE 2 : Products offered for sale
The products are those that appear on the Virtual Landscapes website, i.e. computer files representing 3D scenes and presets that can only be used in the Terragen software. The characteristics of the product are those specified at the time of the order. The rendering of Terragen scenes or presets may differ according to the version of the software used (Terragen versions 2, 3, 4 ..). There may be slight visual differences between the rendering with your version of Terragen and with the sample images provided on the product sheet, especially regarding colors, sharpness and contrast.
ARTICLE 3 : Prices
The prices appearing on the site are prices including all taxes in euro. Virtual Landscapes reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the site on the day of the order will be the only one applicable to the buyer. There are no shipping costs since the products are downloadable computer files.
ARTICLE 4 : Geographical area
The online sale of the products presented on the site is available to the whole world.
The files can be downloaded from the site after payment.
ARTICLE 4 : Orders
The buyer, who wishes to buy a file (objects, scenes or Terragen presets) must
- indicate his personal or company details
- specify the references/descriptions of the chosen products
- make the payment in the conditions provided
- confirm his order and his payment
Confirmation of the order implies acceptance of these terms and conditions of sale, recognition of having full knowledge of them and renunciation of the right to invoke one’s own terms and conditions of purchase or other conditions. All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out. The seller will communicate by e-mail confirmation of the order recorded.
ARTICLE 5 : Return of the products, refund.
In accordance with the law, the right of withdrawal is 14 days provided that the purchased files have not been downloaded since they are unprotected and can be copied.
No refund is possible for a product already downloaded.
ARTICLE 6 : Terms of payment
The price is due at the time of order.
Payments are secured via Stripe or Paypal. As soon as the payment is validated, the buyer receives a link to download the files purchased on the site.
The download link authorizes a single download of purchased files.
ARTICLE 7 : Guarantee
As the products sold by Virtual Landscapes are computer files, no warranty is applicable.
ARTICLE 8 : Responsibility
Virtual Landscapes in the process of selling online, is bound only by an obligation of means; its responsibility cannot be engaged for any damage resulting from the use of the files purchased on the site, of the Terragen software, of the use of the Internet network such as loss of data, intrusion, virus, rupture of service, or other involuntary problems.
ARTICLE 9 : Intellectual Property
All elements of the Virtual Landscapes website are and remain the exclusive intellectual property of Virtual Landscapes. No one is authorized to resell, reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or audio. Any simple link or hypertext link is strictly forbidden without a written agreement from Virtual Landscapes.
The purchase of files proposed on the site does not authorize their duplication, resale and commercial use in several projects. You must purchase a license for each commercial project using these files or based on these files.
ARTICLE 10 : Archiving – Proof
Virtual Landscapes will archive the purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the French Civil Code. The computerized records of Virtual Landscapes will be considered by the parties as proof of communications, orders, payments and transactions between the parties.
ARTICLE 11 : Settlement of disputes
The present conditions of sale on line are subjected to the French law. In case of dispute, jurisdiction is given to the competent courts.
